Courting Debt The legal needs of people facing civil consumer debt problems

A research project focusing on debt issues related to the Magistrates' Court was commissioned. The aims of the project were to:

  • examine the nature of debt-related legal problems which proceeded by way of default judgment in the Magistrates' Court
  • examine the extent to which people who experience such problems sought advice or assistance in relation to their problems
  • assess whether there were any gaps in the provision of debt advice in Victoria, and whether there were opportunities for improvements in the provision of such services.

The project report, Courting Debt: The legal needs of people facing civil consumer debt problems, considers the assistance and legal advice available and taken up by defendants in consumer debt cases in the Magistrates’ Court of Victoria. The report also examines consumer debt with the aim of providing more just outcomes for debtors and easing the burden on court resources.
