Proposed Control of Weapons Regulations 2011

In accordance with section 11 of the Subordinate Legislation Act 1994, notice is given that proposed Control of Weapons Regulations 2011 have been prepared. The proposed regulations will replace the Control of Weapons Regulations 2000, which sunset on 11 December 2011. They will support the operation of the Control of Weapons Act 1990 by:

• prescribing certain articles as prohibited weapons, controlled weapons and body armour
• prescribing certain matters in relation to sales of prohibited weapons
• setting application fees for Chief Commissioner approvals
• prescribing particulars to be included in records of police searches under the Act.

The proposed Regulations have been released for public comment, together with an accompanying Regulatory Impact Statement (RIS). The RIS concludes that while the proposed Regulations involve a higher level of regulation than other options, they are more likely to contribute to the objectives of protecting public safety and mitigating the potential risks and harm arising from the misuse of weapons. The proposed Regulations and RIS can be accessed via the attachments below.

Submissions on the proposed regulations must be received no later than 5.00pm on 22 October 2011.
