Victorian Model Litigant Guidelines
All Australian governments have a common law responsibility to act as model litigants.
Victoria also has its own Model Litigant Guidelines. These are policy guidelines originally issued in 2001 and revised in 2011. They set standards for how the State should behave as a party to legal proceedings.
Broadly, the Guidelines provide that the State should act fairly and consistently, avoid litigation where possible, pay legitimate claims without litigation, and keep litigation costs to a minimum.
All Government departments and agencies and their lawyers are obliged to follow the Guidelines.
