Notification of the proposed Recognition and Settlement Agreement Area for the Dja Dja Wurrung

Q: Why is the State notifying the Victorian Traditional Owners about the proposed Dja Dja Wurrung settlement agreement area?
A:

a. The State is notifying the wider Victorian Traditional Owner community that a traditional owner group, in this case the Dja Dja Wurrung People, is seeking a settlement with the State under the Traditional Owner Settlement Act 2010 (TOS Act).

b. The State seeks the views of Victorian Traditional Owners about whether or not:

  • it is negotiating with the right Traditional Owner group for the proposed settlement area, based on the traditional and cultural association of the group with that area; and
  • the Traditional Owner group is inclusive of all traditional owners for the proposed settlement area;and
  • the proposed agreement area is appropriate for a settlement between the Dja Dja Wurrung People and the State.

c. The notification is not required by any law.

Q: Haven’t the Dja Dja Wurrung Claims already been notified?
A:

a. Yes.

b. The four Dja Dja Wurrung native title claims were publicly notified by the National Native Title Tribunal in 2002, for the purposes of the Commonwealth Native Title Act 1993.

c. The proposed agreement area is not identical to the claim areas notified in 2002.

Q: Who should make a Submission to the State?
A:

a. The State is notifying the Victorian Traditional Owner community to invite comment from Victorian Traditional Owners only.

b. Comment is sought from persons who are Traditional Owners, that is, persons with Aboriginal traditional and cultural associations to certain areas within Victoria.

c. Comment is not sought from persons who are not Victorian Traditional Owners because recognition under the TOS Act  does not affect their interests.

d. Persons who make submissions should state which Traditional Owner Group (s) they identify with.

Q: What things is the State seeking comment about?
A:

a. The State invites comment from Victorian Traditional Owners about whether or not:

  • it is negotiating with the right Traditional Owner group for the proposed settlement area, based on the traditional and cultural association of the group with that area;
  • the Traditional Owner group is inclusive of all traditional owners for the proposed settlement area; and
  • the proposed agreement area is appropriate for a settlement between the Dja Dja Wurrung People and the State.
Q: Who may look at any Submission?
A:

a. Depending on their content, the State may provide a copy of Submissions in response to this Notice to Native Title Services Victoria and to the Dja Dja Wurrung Negotiating Team for the purpose of obtaining their views on the submissions.

Q: Will any Submission be made public?
A:

a. No.

b. However, depending on their content, the State may provide a copy of Submissions in response to this Notice to Native Title Services Victoria and to the Dja Dja Wurrung Negotiating Team for the purpose of obtaining their views on the submissions.

Q: Do Submissions need to be witnessed?
A:

a. No
