Your Privacy

The Department of Justice will only use the information obtained through Working with Children (WWC) Checks as permitted by law. The WWC Check Unit is bound by the Information Privacy Act 2000 and Health Records Act 2001 to collect, use, disclose or otherwise manage the personal information and health information it holds about an individual.

Why do we collect personal information?

The WWC Check Unit collects personal information for the purposes of administering the Working with Children Act 2005 (the Act). Personal information enables the department to:

  • identify the individual
  • process a person’s application
  • obtain information relevant to the individual’s application the individual’s application
  • re-assess a cardholder’s eligibility to hold the card when the department is notified of new relevant offences, charges or findings
  • communicate with the individual about the renewal of their Check, changes to the scheme and litigation before a court or tribunal
  • ensure the individual’s contact details are up-to-date, such as data matching.

What are the consequences of not providing the information?

When a person fails to provide the department with the required personal information:

  • their application may not be considered
  • they may be issued with a Negative Notice
  • their WWC Check card maybe suspended
  • their Renewal Application may not reach them
