Failing the Check
If the Department of Justice is not satisfied that you should be given a Working with Children (WWC) Check card, you will be issued with an Interim Negative Notice then a Negative Notice. The Negative Notice comes into effect from the date on the notice.
A Negative Notice will be issued where you are:
- a Category 1 applicant
- a Category 2 applicant and the department considers that giving you a WWC Check card will pose an unjustifiable risk to the safety of children
- a Category 3 applicant and the department considers it inappropriate to give you a WWC Check card.
A Negative Notice may be issued in other cases, but only if exceptional circumstances exist and only if there is a significant link between offending by the applicant and a risk to children.
