Offences and Penalties
The Working with Children Act 2005 sets out offences against the Act itself, each of which carries a penalty.
It is up to you to be aware of the offences that may be relevant to you as a Working with Children Check applicant or card holder, or as an employer, volunteer organisation or agency engaging or listing people in connection with ‘child-related work’.
The offences and penalties in relation to giving false and misleading information and dealing with confidential information apply to everyone.
See the relevant offences and penalties pages on this website for details of offences and penalties under the Act to determine which are relevant to you.
