Appeal Costs Board - Legal Practitioners Application Instructions

Section 17 applications

In the case of Section 17 Applications, the Section 17 Application Form must be completed and attached to the front of all paperwork.
The Appeal Costs Board will not make any payments until both the adjourned hearing and the subsequent hearing have taken place.
All applications to the Appeal Costs Board must include:

• completed Section 17 Application Form
• a signed copy of that certificate or an authenticated order of the court
• the amount sought from the Board
• the appropriate accounts or Victoria Legal Aid fee forms for both the certificate date(s) and the re-hearing date
• evidence of costs for both hearings– (back sheets, fee slips, invoices, or VLA claim for lump sum fees).
  

Please note: Only applications that include a completed Application Form and contain all supporting material will be accepted.

All other section applications

All other section applications to the Appeal Costs Board must include:

• completed Application Form for the relevant Section
• a signed copy of that certificate or an authenticated order of the court
• the appropriate accounts or Victoria Legal Aid fee forms for both the certificate date(s) and the re-hearing date.

Please note: Only applications that include a completed Application Form and contain all supporting material will be accepted.

Section 17(5) has been amended under the Appeal Costs and Penalty Interest Rates Act (Amendment) Act 2004 (Vic) to allow the Attorney-General to specify the maximum amount payable by the Board. The maximum amounts can be found in the attached “Maximum Amounts” documents.

Appeal Costs Board process

When an application is received by the Registrar of the Board, it is registered, assessed and placed before the Board as soon as practicable. Following the Board meeting, a letter is forwarded to the applicant's solicitors informing them of the Board's decision.
