Review of the Bail Act

The Victorian Law Reform Commission (VLRC) undertook a review of the Bail Act 1977 from 2005 to 2007. On 10 October 2007 the Attorney-General, the Hon Rob Hulls MP tabled the VLRC’s final report, Review of the Bail Act.

The report contains 157 recommendations for procedural, administrative and legislative changes to ensure the bail system functions simply, clearly and fairly.

In the Attorney-General’s Justice Statement, the government committed to amending the Bail Act to make it easier to understand, having regard to the VLRC recommendations.

The VLRC recommendations are being considered in two stages. The discussion paper (which can be accessed below) outlines reforms the Department of Justice puts forward for discussion and possible implementation in stage one of the review.

The department invites submissions on the discussion paper.
