Regulation of Lawyers: Report

A review of the regulation of government lawyers has been undertaken by Crown Counsel, Dr John  Lynch, and Ms Susan Campbell.

The review notes that that government lawyers constitute a significant sector of Victoria’s legal profession and are bound by the same ethical and professional duties and disciplinary regime as other lawyers.

The Review's recommendations include subjecting government lawyers to the same requirement as other lawyers to hold a practicing certificate, establishing a pro bono model for government lawyers, and developing a clearer understanding of the role of government lawyers, in particular the independent nature of their advice.

The government will consider the Review's recommendations in the context of the national reforms to the regulation of the legal profession that are currently being developed.
