Charter of Human Rights and Responsibilities - Regulatory Impact Statement

Under the existing Charter of Human Rights and Responsibilities (Public Authorities) Interim Regulations 2008, the Adult Parole Board, the Youth Residential Board, and the Youth Parole Board (the Boards) are declared not to be ‘public authorities’ for the purposes of the Charter of Human Rights and Responsibilities (the Charter). The effect of the Interim Regulations is to exempt the Boards from the operation of the Charter. The Interim Regulations expire on 29 December 2009.

The Government proposes to make regulations to exempt the Boards for a further four-year period.

A Regulatory Impact Statement (RIS) has been prepared to assess the impact of the proposed regulations.

Public comments or submissions regarding the RIS can be made to the Human Rights Unit, Department of Justice, Level 24, 121 Exhibition St, MELBOURNE VIC 3000. All comments must be made in writing, marked “Parole Boards RIS” and received by 25 November 2009.

It should be noted that all comments and submissions received will be treated as public documents.
