Making a Privacy Enquiry or Complaint

The Department of Justice is committed to ensuring privacy complaints are resolved fairly, swiftly and effectively.

Enquiries or complaints can be made in person, by telephone or in writing about any matter concerning how the Department has managed your privacy, or the privacy of others. Your enquiry or complaint will be handled discreetly by the relevant staff responsible for privacy complaint handling.

Complaints over the telephone can be made to the Senior Privacy Advisor.

Written complaints can be made using a special complaint form or by letter if you prefer not to use the form. Completed complaint forms or letters can be posted to:

What happens after you enquire or complain

The Privacy Coordinator from within the relevant business unit of the department or an officer nominated by the Secretary will usually handle the investigation of any complaint about information privacy. The Privacy Officer, Executive Services will usually give advice in relation to the handling of privacy complaints.

Timeline for handling complaints

The department will endeavour to provide a full response to privacy complaints from an individual within 20 working days. Acknowledgements and progress reports are to be provided to the individual within the 20 working day timeframe.

Review

Any individual dissatisfied with the handling of their privacy complaint has the right to complain to the Office of the Victorian Privacy Commissioner if their complaint concerns personal information or the Office of the Health Services Commissioner if their complaint concerns health information. Making a complaint about other areas of government

If you wish to make a privacy complaint to a public sector body other than the Department of Justice, you should contact that organisation directly. You will find a list of Privacy Officers for each Victorian Government department on this site.
