Applicant Obligations
If you are an employee, a volunteer or self-employed and work with children, you need to determine whether you need to apply for a Working with Children (WWC) Check.
If you are required to apply for a WWC Check, you need to:
- apply before the deadline for your child-related occupational field; it is a criminal offence to engage in ‘child-related work’ if you are required to apply for a WWC Check and have not done so by the due date for your child-related occupational field
- if you are required to apply for a WWC Check and you commence paid or volunteer work after the due date for your type of ‘child-related work’, you will need to apply before you begin duties
- provide true and correct information on your application form
- when requested, show your Application Receipt to your employer, volunteer organisation or the individual or organisation to whom you provide services as evidence that you have applied for a WWC Check
- inform your employer, agency or volunteer organisation (where relevant) and the Department of Justice in writing within seven days if you have a relevant change in circumstances, for example, if you have been charged or found guilty of a new relevant offence.
- inform your employer, agency or volunteer organisation in writing within seven days if you have been issued with an Interim Negative Notice or Negative Notice.
If you do not comply with the above obligations, you may be subject to criminal penalties.
If you are self-employed and also have employees and/or volunteers, please also refer to the employer obligations section of this website.
